Appeal Deadline Calculator
Calculate the deadline to file an appeal based on the date of judgment or order and the applicable jurisdiction/court type.
Formula
Appeal Deadline = Judgment Date + Base Appeal Period + Service Days + Extension Days
If the computed deadline falls on a Saturday, Sunday, or federal legal holiday, it is extended to the next business day (FRAP Rule 26(a)(1)(C); FRCP Rule 6(a)(1)(C)).
- Base Appeal Period: Set by applicable rule (e.g., 30 days for federal civil under FRAP 4(a)(1)(A)).
- Service Days: +3 days added when notice of entry of judgment is served by mail or electronically (FRCP 6(d) / FRAP 26(c)).
- Extension Days: Any court-granted extension added to the base period.
- Weekend/Holiday Roll-Forward: If deadline = Saturday → next Monday; if Sunday → next Monday; if federal holiday → next business day.
Assumptions & References
- Federal appeal periods are governed by the Federal Rules of Appellate Procedure (FRAP), specifically Rule 4.
- The +3 day mail/electronic service rule is based on FRCP Rule 6(d) and FRAP Rule 26(c).
- Weekend and holiday adjustments follow FRAP Rule 26(a)(1)(C) and FRCP Rule 6(a)(1)(C).
- Federal holidays recognized: New Year's Day, MLK Day, Presidents' Day, Memorial Day, Juneteenth (2021+), Independence Day, Labor Day, Columbus Day, Veterans Day, Thanksgiving, Christmas.
- State deadlines vary significantly; the state options shown are common examples only — always verify with the specific state's appellate rules.
- This calculator does not account for tolling due to post-judgment motions (e.g., FRCP Rule 59 motion to alter/amend judgment, which resets the appeal clock under FRAP 4(a)(4)).
- This calculator does not account for bankruptcy stays, prisoner mailbox rules, or other special circumstances.
- All dates are computed in the user's local time zone.
