Formula
Filing Deadline = Trigger Date + 365 Days (1 Calendar Year)
- Single Act: Deadline = Date of Discriminatory Act + 1 Year
- Continuing Violation: Deadline = Last Date of Ongoing Discriminatory Conduct + 1 Year
- Days Remaining = Deadline Date − Today's Date
- % Window Used = (Days Elapsed ÷ 365) × 100
The calculator uses exact calendar-year addition (anniversary date). If the deadline falls on a weekend or federal holiday, HUD generally accepts the next business day, but complainants should not rely on this extension.
Assumptions & References
- Statutory Authority: Fair Housing Act, 42 U.S.C. § 3610(a)(1)(A)(i) — complaints must be filed within one year after the alleged discriminatory housing practice occurred or terminated.
- Continuing Violations: Under HUD regulations (24 C.F.R. § 103.20) and case law, the limitations period for a continuing violation runs from the last act of discrimination, not the first.
- Tolling: The 1-year period may be tolled (paused) in limited circumstances, including fraudulent concealment, mental incapacity, or minority status of the complainant. This calculator does not account for tolling.
- FHAP Agencies: Filing with a HUD-certified Fair Housing Assistance Program (FHAP) state or local agency may satisfy the federal deadline. Verify with your local agency.
- Private Lawsuit: A private civil action under 42 U.S.C. § 3613 has a separate 2-year statute of limitations and is not calculated here.
