Assumptions & References
- Filing fees are based on the USPTO fee schedule effective January 18, 2025: TEAS Plus $250/class, TEAS Standard $350/class.
- A trademark class corresponds to one of the 45 Nice Classification categories of goods or services.
- TEAS Plus requires use of pre-approved ID Manual descriptions and has stricter requirements but lower fees.
- Intent to Use (1b) applications require a Statement of Use ($100/class) or Extension of Time before registration is granted.
- Attorney fees are estimates; typical U.S. trademark attorneys charge $1,000–$2,500 for a single-class application.
- Office action response costs vary widely ($300–$1,500+) depending on complexity.
- §8 Declaration of Continued Use must be filed between years 5–6 post-registration.
- §9 Renewal must be filed every 10 years to maintain the registration.
- §15 Declaration of Incontestability is optional but provides stronger legal protection after 5 years of continuous use.
- This estimator does not include state trademark registration fees, international (Madrid Protocol) fees, or litigation costs.
